1 Acceptance of Terms
Welcome to MyMBill. These Terms and Conditions ("Terms") govern your access to and use of MyMBill billing software, website (www.mymbill.com), mobile applications, and related services (collectively, the "Services") provided by MyMBill ("Company," "we," "us," or "our").
By accessing, downloading, installing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.
These Terms constitute a legally binding agreement between you (whether an individual or entity) and MyMBill. Please read them carefully.
Important: By clicking "I Agree," "Sign Up," or by using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2 Definitions
For the purpose of these Terms:
- "Account" means the unique account created for you to access our Services
- "Application" or "App" means the MyMBill software program for desktop, mobile, or web
- "Business Data" means all data you create, import, or generate using our Services
- "Content" means any information, data, text, graphics, or materials
- "Device" means any computer, mobile phone, or digital device
- "Subscription" means the paid plan you select to use our Services
- "User" means any individual who accesses or uses the Services
- "License Key" means the unique code provided to activate your subscription
- "GST" means Goods and Services Tax as applicable in India
3 Our Services
MyMBill provides comprehensive billing and business management software solutions including:

- Retail: POS system, loyalty programs, discount management
- Salon & Spa: Appointment booking, service packages
- Grocery: Weight-based billing, home delivery management
- General Business: Quotations, purchase orders, delivery challans

4 Eligibility
To use MyMBill Services, you must:
- Be at least 18 years of age
- Have the legal authority to enter into binding contracts
- If representing a business, have authorization to bind that entity
- Not be prohibited from using the Services under applicable laws
- Provide accurate and complete registration information
By using our Services, you represent and warrant that you meet all eligibility requirements.
5 Account Registration
5.1 Account Creation
To access certain features, you must create an account by providing:
- Valid email address
- Mobile phone number
- Business name and address
- GST number (if applicable)
- Secure password
5.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring only authorized users access your account
5.3 Multiple Devices
Depending on your subscription plan:
- Single Device License: Software can be installed on one device only
- Multi-Device License: Software can be installed on specified number of devices
- Enterprise License: Unlimited devices within your organization
Warning: Sharing your license key with unauthorized parties is a violation of these Terms and may result in immediate termination without refund.

6.2 Enterprise Plans
For businesses with multiple branches or special requirements, we offer customized enterprise plans. Contact our sales team at sales@mymbill.com for pricing.
6.3 Pricing Changes
- All prices are in Indian Rupees (INR) and subject to 18% GST
- We may modify pricing with 30 days advance notice
- Existing subscriptions continue at the original price until renewal
- Promotional discounts apply only for the initial term
7 Payment Terms
7.1 Payment Methods
We accept the following payment methods:
- Credit Cards (Visa, MasterCard, American Express, RuPay)
- Debit Cards
- UPI (Google Pay, PhonePe, Paytm, BHIM)
- Net Banking (All major Indian banks)
- Digital Wallets (Paytm, Amazon Pay)
- NEFT/RTGS/IMPS (for enterprise customers)
7.2 Billing Cycle
- Subscriptions are billed in advance for the selected period
- Billing cycle starts from the date of successful payment
- For auto-renewal, payment is charged on the renewal date
- Failed payments result in service suspension after 7-day grace period
7.3 Taxes
- All prices are exclusive of GST unless stated otherwise
- GST at 18% will be added to your invoice
- You are responsible for any other applicable taxes in your jurisdiction
- GST invoice will be provided for all payments
7.4 Auto-Renewal
By default, subscriptions auto-renew to ensure uninterrupted service:
- You will receive email reminders 7 days and 1 day before renewal
- You can disable auto-renewal from your account dashboard anytime
- Auto-renewal will be at the then-current pricing
- If payment fails, we will retry 3 times over 7 days
7.5 Invoices & Receipts
- Digital invoice sent to your registered email immediately after payment
- All invoices available in your account dashboard
- Invoices are GST-compliant and can be used for tax credits
For Corporate Purchases: We offer PO (Purchase Order) based billing for enterprise customers. Contact accounts@mymbill.com for details.
8 License & Usage Rights
8.1 License Grant
Subject to these Terms and payment of applicable fees, MyMBill grants you a:
- Non-exclusive - We can license to others
- Non-transferable - You cannot transfer to others
- Revocable - Can be terminated per these Terms
- Limited - For specified devices only

8.3 Updates & Upgrades
- Minor Updates: Bug fixes and minor improvements included free
- Major Updates: New features included during active subscription
- Version Upgrades: Major version changes may require additional payment for lifetime licenses
9 Usage Restrictions
You agree NOT to:
- Copy, modify, or distribute the Software
- Reverse engineer, decompile, or disassemble the Software
- Remove or alter any proprietary notices or labels
- Rent, lease, lend, or sublicense the Software
- Use the Software for illegal purposes
- Share your license key with unauthorized parties
- Create fake invoices or engage in fraudulent activities
- Overload or interfere with our servers or networks
- Use automated tools to access the Services without permission
- Attempt to gain unauthorized access to any systems
- Use the Software to compete with MyMBill
Violation: Any violation of these restrictions may result in immediate termination of your license, legal action, and forfeiture of all fees paid.
10 Data Ownership
10.1 Your Data
You retain full ownership of all Business Data you create or upload using our Services, including:
- Customer and vendor information
- Product and inventory data
- Invoices, bills, and financial records
- Reports and analytics generated
10.2 Our Rights
MyMBill owns all rights to:
- The Software, its code, design, and architecture
- Our trademarks, logos, and branding
- Documentation and training materials
- Aggregated, anonymized usage statistics
10.3 Data Portability
You can export your data at any time in standard formats (CSV, Excel, PDF). Upon termination, you have 30 days to export your data before it is deleted from our servers (if cloud backup was enabled).
10.4 Backup Responsibility
While we provide backup features, you are ultimately responsible for maintaining backups of your data. We recommend:
- Regular local backups to external storage
- Enabling cloud backup for additional protection
- Testing backup restoration periodically
11 GST Compliance
11.1 GST-Compliant Invoicing
MyMBill generates invoices compliant with GST regulations including:
- Proper invoice numbering sequence
- HSN/SAC codes for products/services
- CGST, SGST, IGST calculations
- Supplier and recipient GSTIN display
- Digital signature support
11.2 Your Responsibilities
You are responsible for:
- Entering correct GST rates and HSN codes
- Verifying customer GSTIN before generating invoices
- Filing GST returns with the tax authorities
- Maintaining records as per GST law requirements
11.3 Disclaimer
While MyMBill facilitates GST-compliant billing, we are not responsible for:
- Incorrect data entered by users
- Changes in GST laws or rates
- Penalties due to non-compliance by users
- Tax filing errors or omissions
We recommend consulting a qualified tax professional for GST compliance matters.

12.2 Support Hours

12.3 Maintenance Windows
Scheduled maintenance for cloud services typically occurs:
- Sundays, 2:00 AM - 6:00 AM IST
- Advance notice of 48 hours for planned maintenance
- Emergency maintenance may occur without notice
13 Warranties & Disclaimers
13.1 Limited Warranty
MyMBill warrants that:
- The Software will perform substantially as described in documentation
- We will make reasonable efforts to maintain service availability
- We have the right to grant the license provided herein
13.2 Disclaimer
EXCEPT AS EXPRESSLY STATED, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS
- UNINTERRUPTED OR ERROR-FREE OPERATION
13.3 No Guarantee
We do not guarantee that:
- The Software will meet all your requirements
- The Software will be compatible with all devices/systems
- All errors or bugs will be corrected
- The Services will always be available
14 Limitation of Liability
14.1 Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYMBILL'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
14.2 Exclusion of Damages
WE SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, or business
- Loss of data or data corruption
- Business interruption
- Damages from unauthorized access to your account
- Damages from third-party conduct
14.3 Exceptions
These limitations do not apply to:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded by law
15 Termination
15.1 Termination by You
You may terminate your account at any time by:
- Contacting our support team
- Using the account deletion option in settings
- Allowing your subscription to expire without renewal
15.2 Termination by Us
We may suspend or terminate your access if you:
- Violate any provision of these Terms
- Fail to pay applicable fees
- Engage in fraudulent or illegal activities
- Misuse the Software or abuse our systems
- Upon request of law enforcement
15.3 Effect of Termination
Upon termination:
- Your license to use the Software ends immediately
- You must cease all use of the Software
- You must delete all copies of the Software
- You have 30 days to export your data
- No refund for unused subscription period (see Refund Policy)
- We may delete your data after 30 days
15.4 Survival
Sections regarding Intellectual Property, Limitation of Liability, Indemnification, and Dispute Resolution survive termination.
16 Dispute Resolution
16.1 Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Kolkata, West Bengal, India.
16.2 Informal Resolution
Before initiating formal proceedings, you agree to contact us at legal@mymbill.com and attempt to resolve the dispute informally for at least 30 days.
16.3 Arbitration
If informal resolution fails, disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English in Kolkata, India.
16.4 Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or representative proceedings.
17 Changes to Terms
We may modify these Terms at any time. When we make changes:
- We will update the "Last Updated" date
- Material changes will be notified via email or in-app notification
- You will have 30 days to review changes before they take effect
- Continued use after changes constitutes acceptance
- If you disagree, you may terminate your account before changes take effect
